Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") define the conditions for using the service (hereinafter referred to as "the Service") provided on this website by Fujitech LLC (hereinafter referred to as "the Company"). All registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Applicability)

These Terms shall apply to all relationships between Users and the Company regarding the use of the Service. The Company may establish various rules (hereinafter referred to as "Individual Provisions") in addition to these Terms. Regardless of their name, Individual Provisions shall constitute part of these Terms. In case of conflict between these Terms and Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.

Article 2 (User Registration)

For this Service, registration shall be completed when a prospective registrant agrees to these Terms, applies for registration using the Company's designated method, and the Company approves the application. The Company may refuse registration applications without disclosing reasons if the applicant has any of the following circumstances.

Article 3 (User ID and Password Management)

Users shall properly manage their User IDs and passwords for the Service at their own responsibility. Under no circumstances may Users transfer, lend, or share their User IDs and passwords with third parties. The Company shall treat login attempts matching registered User IDs and passwords as use by the registered User.

Article 4 (Fees and Payment Method)

Users shall pay the fees separately determined by the Company and displayed on this website for the paid portions of the Service, using the payment method designated by the Company. If Users delay payment of fees, they shall pay late payment damages at an annual rate of 14.6%.

Article 5 (Prohibited Conduct)

Users shall not engage in the following acts when using the Service:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activities
  3. Acts that destroy or interfere with the functions of servers or networks of the Company, other Users of the Service, or third parties
  4. Acts that may interfere with the operation of the Company's services
  5. Acts of collecting or accumulating personal information about other Users
  6. Acts of unauthorized access or attempts thereof
  7. Other acts deemed inappropriate by the Company

Article 6 (Service Suspension)

The Company may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following circumstances exist. The Company shall not be liable for any disadvantages or damages suffered by Users or third parties in such cases.

Article 7 (Usage Restrictions and Registration Deletion)

The Company may, without prior notice, restrict all or part of a User's use of the Service or delete the User's registration if the User falls under any of the following circumstances. The Company shall not be liable for any damages caused to Users by actions taken under this Article.

Article 8 (Withdrawal)

Users may withdraw from the Service through the withdrawal procedures established by the Company.

Article 9 (Disclaimer and Limitation of Liability)

The Company does not guarantee, either explicitly or implicitly, that the Service is free from factual or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, and rights infringement). The Company shall not be liable for any damages caused to Users arising from the Service. However, this disclaimer shall not apply if the contract between the Company and Users regarding the Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act.

Article 10 (Changes to Service Content)

The Company may change the content of the Service or discontinue providing the Service without notice to Users, and shall not be liable for any damages caused to Users thereby.

Article 11 (Changes to Terms of Service)

The Company may change these Terms at any time without notice to Users if deemed necessary. If a User begins using the Service after changes to these Terms, that User shall be deemed to have agreed to the revised Terms.

Article 12 (Handling of Personal Information)

The Company shall appropriately handle personal information obtained through the use of the Service in accordance with the Company's Privacy Policy.

Article 13 (Notices and Communications)

Notices or communications between Users and the Company shall be made using the method designated by the Company. Unless the Company receives a change notification from Users in the form separately prescribed by the Company, the Company shall treat the currently registered contact information as valid and send notices or communications to that contact information, which shall be deemed to have reached Users at the time of transmission.

Article 14 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer or pledge their position under the usage contract or their rights or obligations under these Terms to third parties without the Company's prior written consent.

Article 15 (Governing Law and Jurisdiction)

Japanese law shall be the governing law for the interpretation of these Terms. In case of disputes regarding the Service, the court having jurisdiction over the location of the Company's head office shall have exclusive agreed jurisdiction.
